Create your COMPLEX Will
Basic or Deluxe Wills may not be appropriate for everyone. Your situation may require special provisions not included in the Basic or Deluxe Wills. I will draft a custom COMPLEX WILL containing special provoions to meet all of your goals and requirements.
Terms and Conditions for your COMPLEX WILL. You must agree to the folowing Terms and Conditions. These Terms and Conditions create the legal services agreement between us allowing me to create your COMPLEX WILL for you.
TERMS AND CONDITIONS: You must accept these terms and conditions which establish our Limited Scope Legal Service Agreement for this matter.
I am licensed to practice law in North Dakota and Minnesota. If you live in North Dakota you are creating a North Dakota Will. If you live in Minnesota you are creating a Minnesota Will.
I will review the information that you provide to prepare a COMPLEX WILL for either a single person or a married couple for a flat fee of $850.00. Your COMPLEX WILL includes a General Durable Power of Attorney and a Health Care Power of Attorney at no additional cost. The fee can be paid by sending me a check at: Al Baker Attorney @ Law, 1336 25th Avenue South, Fargo, North Dakota 58103, OR paid by credit card through my website (I will also send you an email with a link to make a payment online by credit using my Lawpay account).
COMPLEX WILLS include:
1. A statement that all prior Wills are revoked;
2. Instructions that all legal debts and expenses be paid, including taxes and medical and funeral expenses;
3. Appointment of a Personal Representative and an alternate Personal Representative to serve without bond;
4. A provision for a Separate Writing to dispose of tangible personal property as allowed by North Dakota and Minnesota law;
5. Designation of Beneficiaries to receive a specific bequest (If a Beneficiary dies before you, then your Will provides that the deceased Beneficiary’s specific gift will go to that Beneficiary’s surviving children, if the deceased Beneficiary has no surviving children then that share will become part of your residuary estate.);
6. Designation of Beneficiaries to receive a set percentage of your residuary estate (If a Beneficiary dies before you, then your Will provides that the deceased Beneficiary’s share will go to that Beneficiary’s surviving children, if the deceased Beneficiary has no surviving children then that share will go to your surviving Beneficiaries according to the shares you have determined that they will receive.);
7. Appointment of a Guardian for your minor children;
8. Establishes a testamentary Trust for your Beneficiaries and a minimum age for distribution of the Trust;
9. Appoints a Trustee to manage your testamentary Trust; and
10. Allows both Client and Spouse to name separate Personal Representative, Trustee, Guardian and Beneficiaries if they choose to.
11. Other special provisions needed to accomplish your goals. We will discuss these provisions in detail during our conference.
You will be asked to provide information for the “CLIENT” and for the client’s “SPOUSE.” It does not make any difference whether the “CLIENT” is a man or a woman, I just needed some way to differentiate between the two people making a married couple’s COMPLEX WILL. With a COMPLEX WILL the Spouse’s Will can be a mirror image of the Client’s will (These types of wills are sometimes called “sweetheart” wills) or the Spouse can name a separate Personal Representative, Trustee, Guardian and Beneficiaries.
If you choose to add a General Power of Attorney or a Health Care Power of Attorney both the Client and the Spouse can choose different people to act as their agents; the Client’s and Spouse’s General Power of Attorney and the Health Care Power of Attorney are not required to be mirrors of each other.
Your COMPLEX WILLS will be drafted based on the information you provide. After I receive your Will Information Form and the required payment I will email instructions to you for scheduling an appointment with me. The appointment will be an online meeting, a telephone conference or an in-person meeting at my Fargo office. At this point your fee deposit is fully refundable if you are unsatisfied with the process or if I can not draft COMPLEX WILLS that meet your requirements and are approved by you. After the scheduled conference your final COMPLEX WILLS will be emailed to you with instructions for signing your WILLS. It is your responsibility to follow the signing instructions and properly sign your Will. You may choose to make an appointment to come to my Fargo office to sign your Will.
I am being retained to prepare COMPLEX WILLS for a married couple or a COMPLEX WILL for a single person, based on the information you have provided. This is a limited scope legal service agreement. You have not hired me to make sure your COMPLEX WILLS are properly signed. You have not hired me to monitor your situation in the future to determine if the documents that have been prepared remain appropriate for you. The service that I am providing is for your benefit only and is not being provided for the benefit of any heir or devisee that you may have or designate.

The INSTRUCTION BOOKLET describes the information that you will need to complete your Information Form and allows you to make notes before starting to fill out the Information Form.
To start the process of preparing your COMPLEX WILL we will use the Information Form for a Deluxe Will. This is just a starting point and allows me to obtain some of your basic information. After I receive your Information Form and your fee deposit I will contact you to schedule a meeting with me by an on-line Web Conference, telephone conference or meeting at my Fargo office.
Complete this Google Form and “SUBMIT” it.
Your information is automatically transfered to me. I will prepare your WILL and contact you to schedule a conference to review your WILL. After we have reviewed your WILL together I will send your WILL to you.
